# Is there a statute of limitations on unfiled returns?

The short answer

The 10 year collection clock starts when a tax is assessed. If you never filed, there may be no assessment yet, so the clock may not have started for that year. The IRS can file a substitute return, which leads to an assessment.

Refunds have their own limit: claim them within 3 years of the due date.
